2018 health privacy breach reporting requirements

According to new rules under the Personal Health Information Protection Act (PHIPA), health information custodians in Ontario are now required to report statistics relating to health privacy breaches annually to the Information and Privacy Commissioner of Ontario's (IPC) office, which oversees compliance with PHIPA.

Examples of health information custodians include health care practitioners such as doctors, nurses, pharmacists, speech-language pathologists, chiropractors, dental professionals, dieticians, medical laboratory technologists, massage therapists, midwives, occupational therapists, opticians and physiotherapists. This statistical report will set out the number of times in 2018 that personal health information held by a health information custodian was stolen, lost, used without authority and/or disclosed without authority. The other sections of the report will focus on the cause of the breach and the number of individuals affected. The report does not ask for personal health information.

The IPC online statistics submission website is now open for health information custodians across Ontario to submit their statistics for the 2018 reporting year. Health information custodians that have experienced at least one health privacy breach during the 2018 reporting year—from January to December—are required by law to complete the online questionnaire. The deadline to submit is Friday, March 1, 2019.

Important information about late fees and suspensions for MLTs

All MLTs in Ontario were notified of the CMLTO’s 2019 Annual Registration Renewal requirements by letter mail in October 2018, and the online renewal platform became available on November 1, 2018. The opportunity to renew the CMLTO membership without penalty ended on December 31, 2018. Members who failed to renew by the deadline will receive a Notice of Intention to Suspend from the Registrar & CEO in the coming week.

Late fees and suspensions for MLTs

All MLTs in Ontario were notified of the CMLTO’s 2019 Annual Registration Renewal requirements by letter mail in October 2018, and the online renewal platform became available on November 1, 2018. The opportunity to renew the CMLTO membership without penalty ended on December 31, 2018. Members who failed to renew by the deadline will receive a Notice of Intention to Suspend from the Registrar & CEO in the coming week. 

Members wishing to renew their membership can still do so until 11:59 pm EST, on Friday, February 8, 2019, at www.cmlto-onlineservices.com, however, late fees have now been added to renewal fees. 

All MLTs who have not renewed their membership by 11:59 pm EST on Friday, February 8, 2019, will have their certificate of registration suspended. If a member’s certificate of registration is suspended, the Registrar & CEO will notify the member and their employers by mail. Upon suspension, the certificate of registration expires, and the former member is no longer authorized to practise medical laboratory technology in Ontario. 

Further, a permanent notation of the suspension (and subsequent reinstatement, if applicable) will appear in the MLT’s record in the CMLTO Public Register. A list containing the names of all suspended medical laboratory technologists will be published in the FOCUS newsletter.

The OHR site now contains links to all the Colleges that have web pages which list their public consultations. Visit the OHR Public consultations page. The CMLTO's Consultations & feedback page contains information about providing comments to the College.
