Professional Conduct
The College of Medical Laboratory Technologists of Ontario (CMLTO) has a duty to regulate the profession in the public interest. One of the primary ways the CMLTO fulfills this mandate is by dealing appropriately with complaints and concerns about the conduct of medical laboratory technologists (MLTs) in Ontario.
Complaints
The CMLTO is required to investigate all complaints received regarding the conduct of its members. The Inquiries, Complaints and Reports Committee (ICRC) investigates all complaints, and then issues a decision (and the reasons) to the member and the complainant.
Mandatory Reports
Employers are required to file a report with the CMLTO if they terminate an MLT’s employment, suspend an MLT, or restrict an MLT’s practice for reasons of professional misconduct, incompetence, or incapacity.
Discipline
The Discipline Committee of the CMLTO holds hearings to determine if an MLT has engaged in an act of professional misconduct or is incompetent to practice. If so, the Discipline Committee determines the appropriate penalty, which may include a reprimand, fines of up to $35,000, suspensions, terms, limitations and conditions on a certificate of registration, or revocation of registration.
Fitness to Practise
The ICRC also handles concerns regarding an MLT’s physical and/or mental condition, and their impact on that MLT's ability to practice safely. In these cases, Inquiry Panels are struck to gather information about the member's condition. Inquiry Panels work with members to ensure the member's condition is properly monitored and managed and the public is protected. If necessary, the issue of an MLT’s capacity to safely continue practising with a physical or mental condition may be referred to the Fitness to Practise Committee for a hearing and determination.
